Older workers should have the same rights as every other worker to be treated fairly in the workplace based on their merits, not on stereotypes and outdated assumptions. But, ten years ago, a Supreme Court ruling made it much harder to prove age discrimination than other forms of discrimination. What’s more, the courts have since used this ruling to weaken protections under other civil rights laws such as Title VII and the Americans with Disabilities Act. The Protecting Older Workers Against Discrimination Act (POWADA) is bipartisan legislation to help level the playing field for older workers and restore a standard that makes clear no amount of discrimination is acceptable in the workplace.
